E-Discovery is the production and presentation of electronically stored information (ESI)that meets the basic requirements and needs of discovery. With companies getting sued every day, opposing counsel preys on companies that don’t have their act together, often to make a profit and demand actions that are burdensome and costly for the defendant. This often forces out of court settlement simply because they don’t know what they have or don’t have, or the cost of production is prohibitive to defending the case. With the new amendments to the FRCP, organizations must be more prepared now, because the window to respond is much smaller – fueling the associated costs and risks of e-Discovery.
